Requesting an IEE

An Independent Educational Evaluation is an evaluation that is not conducted by school district personnel but is provided at no cost to the parents of a student with a disability. It can only be requested after a special education evaluation has already been done, to which you disagree. In order to request one, send your request in writing to your student’s IEP case manager (this can be an email) stating that you disagree with the evaluation and request an IEE. You may be asked for a reason, but are not required by law to give a reason for your request. Keep in mind in Washington state, the school district must either provide the IEE without unnecessary delay, OR initiate a due process hearing against you within 15 days to show that its evaluation is appropriate. An administrative law judge may also request an IEE for a student as part of a due process hearing.
